The Settlement Fund was created as a result of a Settlement Agreement reached in Betty Johnson v. Eloy S. Inos, et al., Case No. 09-00023, which was approved by the U.S. District Court for the NMI. The Settlement Fund accepted certain assets of the NMI Retirement Fund and was established to ensure that Settlement Class Members receive at least 75% of their Full Benefits, as defined in the Settlement Agreement. The Settlement Agreement requires the NMI Government to make annual payments to the Settlement Fund, which are necessary for the Settlement Fund to pay 75% of Class Members’ Full Benefits.
